Terms of service

1. Who we are
StoolSense ("StoolSense", "we", "us") is operated by an individual based in Portugal. These terms apply to the StoolSense mobile app and website (stoolsense.app and stoolsense.io).

2. Acceptance
By downloading, installing, or using the app, or by accessing the website or joining the waitlist, you agree to these Terms and our Privacy Policy. If you do not agree, do not use StoolSense.
3. Not a medical device
StoolSense is not a medical device and does not provide medical advice, diagnosis, or treatment. It is a personal self-tracking tool for logging gut health observations and exploring general educational content.
Nothing in the app or on the website should be interpreted as medical advice. If you have symptoms, health concerns, or suspect a medical condition, consult a qualified healthcare professional. Do not delay or disregard professional medical advice because of anything you see in StoolSense.

4. AI photo analysis
The optional photo analysis feature uses AI vision models to estimate the Bristol Stool Scale type of a submitted image. This analysis is approximate and for personal convenience only. It is not a clinical assessment, does not have diagnostic accuracy, and should not be used to make health decisions.
AI analysis depends on third-party APIs (Google Gemini, OpenAI). Results may vary, be incorrect, or be unavailable. Always apply your own judgement.
5. Your data
Your health logs are stored locally on your device in a SQLite database. You own your data. We do not upload, access, or hold your structured health data on our servers.
You can permanently delete all app data at any time via Settings → Wipe local data.
6. Acceptable use
You agree not to:
- Use StoolSense for any unlawful purpose or in violation of any applicable law.
- Submit illegal, harmful, or offensive content through any feature, including photo submissions.
- Attempt to abuse, reverse-engineer, overload, or circumvent the AI analysis feature or API proxy.
- Misrepresent your identity or impersonate others.
- Interfere with or disrupt the integrity of the service.
7. AI feature availability
AI-powered features (photo analysis, Smart Analysis) depend on third-party APIs and may be temporarily or permanently unavailable due to API outages, capacity limits, policy changes, or other factors outside our control. We do not guarantee continuous availability of these features.
8. Waitlist and communications
By joining the waitlist, you authorize us to email you about beta access, product updates, and related announcements. You can unsubscribe at any time by following the link in any email or by emailing us.
9. Intellectual property
The StoolSense app, website, and their content (text, design, branding, library articles) are owned by StoolSense or our licensors and are protected by applicable intellectual property laws. You may not copy, reproduce, or distribute substantial portions of the content for commercial purposes without permission.
10. Disclaimers
StoolSense is provided "as is" and "as available". We make no warranty that the app or website will be uninterrupted, error-free, or free of security vulnerabilities. We are not responsible for the accuracy, completeness, or usefulness of any content.
11. Limitation of liability
To the maximum extent permitted by applicable law, StoolSense and its operator will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, health outcomes, or goodwill arising from your use of or inability to use the service.
Our total liability for any claim arising from these terms or your use of StoolSense will not exceed the amount you paid us in the twelve months preceding the claim.
12. Third-party services
StoolSense relies on third-party services including Supabase, Google AI, and OpenAI. Your use of the app is also subject to their respective terms and policies. We are not responsible for their performance, availability, or data practices.
13. Changes
We may update these terms from time to time. The updated version will be posted at this URL with a new effective date. Continued use of StoolSense after changes are posted constitutes your acceptance of the revised terms.
14. Governing law
These terms are governed by the laws of Portugal, without regard to conflict-of-law rules.
